Multiple wings of the South Korean military apparatus assured the public on Friday that President Yoon Suk-yeol would not attempt to impose martial law for a second time this week, responding to spreading rumors that Yoon may attempt to exercise that power before an impeachment vote scheduled for Saturday. A senior army official, Commander Kwak Jong-keun, went further, telling lawmakers on Friday that, even if Yoon attempted to decree martial law, the Army Special Warfare Command would ignore him, according to the Korea JoongAng Daily . An unnamed top official in the Defense Ministry issued the same promise to disregard presidential orders should they come to impose military rule on the country. Some members of the left-wing Democratic Party and a group called the Center for Military Human Rights Korea suggested on Friday that Yoon may attempt to declare military rule a second time before he was impeached, prompting the multiple denials and assurances that, even if Yoon tries, the military would not follow his orders. “If there ever is a call for declaring martial law once again, the Defense Ministry and the Joint Chiefs of Staff will not allow it,” the news agency Yonhap quoted a Defense Ministry official as saying. Yonhap added that the Joint Chiefs of Staff (JCS) itself also said it would not obey a martial law order, but emphasized, “there will not be a second declaration.” Acting Defense Minister Kim Seon-ho said at an emergency press conference on Friday that “rumors ... on signs of another martial law declaration are not true.” “Even if there is an order for martial law issuance, the defense ministry and the Joint Chiefs of Staff (JCS) will never accept it,” he promised . Kim Seon-ho took over from Yoon’s longstanding defense minister, Kim Yong-hyun, on Thursday, after he tendered his resignation . Kim Yong-hyun, a high school classmate of Yoon’s, is rumored to have been the only cabinet official informed of the martial law plans before they were enacted; some reports suggested that Kim may have even been the originator of the idea. Yoon, a conservative, appeared on television and declared martial law late on Tuesday, a shocking announcement that almost no one in the nation expected or had previous knowledge of, including many in Yoon’s inner circle. Yoon claimed the martial law decree was necessary to combat leftist obstructionism in the National Assembly and alleged that the government had been infiltrated by “North Korean communist forces” and “unscrupulous pro-Pyongyang anti-state forces,” but never named any of the alleged infiltrators or offered evidence for these claims. The declaration prompted disgust and opposition from every sector of South Korean politics, including Yoon’s own People Power Party (PPP), which moved rapidly to distance itself from the announcement. Lawmakers stormed the National Assembly to use their constitutional power to vote against martial law, forcing their way through a column of soldiers dispatched to enforce a ban on political action. The Assembly unanimously voted against martial law and Yoon rescinded the order a few minutes later. Yoon has not addressed the public since. Even in obeying this order, the military appeared not to enforce the ban on entering the National Assembly with much force, as unarmed lawmakers in suits managed to keep throngs of young, heavily armed soldiers from breaking up the vote against martial law. Kwak, the army commander, said on Friday that he refused to follow the orders to break up the meeting. “I judged that dragging out lawmakers was clearly illegal, and so though it would be considered disobedience I did not follow orders,” he asserted. Yoon is scheduled to face an impeachment vote on Saturday. To pass, and to oust him from power, two-thirds of the National Assembly must vote in its favor, which would require eight members of the PPP to vote to expel their own president. The PPP initially opposed impeachment, proposing instead to pass a constitutional amendment to shorten term limits and in that way get rid of Yoon before the end of his tenure. By Friday, however, at least one PPP assemblyman said he would vote for impeachment and the party leader, Han Dong-hoon, told reporters Yoon needs to vacate the presidency as soon as possible. “Although it would be hard to change the party’s stance on Yoon’s impeachment vote, my opinion is that Yoon should be suspended from duty,” Han said , according to the Korea JoongAng Daily, stating that he “had not heard any remarks to reverse a judgment of suspending Yoon Suk Yeol from presidential duty.” Han made the comments after meeting with Yoon on Friday – and after reports surfaced that Yoon had ordered Han’s arrest on Tuesday, among other political leaders. In addition to impeachment, Yoon is facing a police investigation into criminal charges of treason for the martial law order. The Rebuilding Korea party filed criminal charges against Yoon this week; police have confirmed an investigation into whether Yoon acted outside of his constitutional authority in a criminal fashion or not is underway. Jensen Huang, the chief executive of Nvidia, is the 10th-richest person in the United States, worth $US127 billion ($198.6 billion). In theory, when he dies, his estate should pay 40 per cent of his net worth to the government in taxes. But Huang, 61, is not only an engineering genius and Silicon Valley icon whose company, the world’s second-most valuable, makes the chips that power much artificial intelligence. He is also the beneficiary of a series of tax dodges that will enable him to pass on much of his fortune tax-free, according to securities and tax filings reviewed by The New York Times . His family’s savings are on pace to be roughly $US8 billion ($12.5 billion). This likely ranks among the largest tax dodges in the United States. It is just one sign of how the estate tax – imposed on a sliver of the country’s multimillionaires – has been eviscerated. Revenue from the tax has barely changed since 2000, even as the wealth of the richest Americans has roughly quadrupled. If the estate tax had kept pace, it would have raised around $US120 billion ($187 billion) last year. Instead, it brought in about a quarter of that. The story of Huang’s tax avoidance is a case study of how the ultrarich bend the US tax system for their benefit. His strategies were not explicitly authorised by Congress. Instead, they were cooked up by creative lawyers who have exploited a combination of obscure federal regulations, narrow findings by courts, and rulings that the IRS issues in individual cases that then served as models for future tax shelters. ‘Don’t expect anyone in Congress to stop this’ “You have an army of well-trained, brilliant people who sit there all day long, charging $US1,000 an hour, thinking up ways to beat this tax,” said Jack Bogdanski, a professor at Lewis & Clark Law School and the author of a widely cited treatise on the estate tax. “Don’t expect anyone in Congress to stop this.” The richest Americans can pass down approximately $US200 billion ($312 billion) each year without paying estate tax on it, thanks to the use of complex trusts and other avoidance strategies, estimated Daniel Hemel, a tax law professor at New York University. Enforcement of the rules governing the estate tax has eased in part because the IRS has been decimated by years of budget cuts. Credit: AP The trend is likely to accelerate with Republicans controlling both the White House and Capitol Hill. They are already slashing funding for law enforcement by the IRS. The incoming Senate majority leader, John Thune, and other congressional Republicans for years have been trying to kill the estate tax, branding it as a penalty on family farms and small businesses. Yet, Huang’s multibillion-dollar manoeuvre – detailed in the fine print of his filings with the Securities and Exchange Commission and his foundation’s disclosures to the IRS - shows the extent to which the estate tax has already been hollowed out. An Nvidia spokesperson, Stephanie Matthew, declined to discuss details of the Huangs’ tax strategies. The United States adopted the modern estate tax in 1916. In recent decades, congressional Republicans have successfully watered it down, cutting the rate and increasing the amount that is exempt from the tax. Today, a married couple can pass on about $US27 million ($42 million) tax-free; anything more than that is generally supposed to be taxed at a 40 pr cent rate. Can you dig it? In 2012, Huang and his wife, Lori, took one of their first steps to shield their fortune from the estate tax. They set up a financial vehicle known as an irrevocable trust and moved 584,000 Nvidia shares into it, according to a securities disclosure Huang filed. The shares were worth about $US7 million ($11 million) at the time, but they would eventually generate tax savings many times greater. The Huangs were taking advantage of a precedent set nearly two decades earlier, in 1995, when the IRS blessed a transaction that tax professionals affectionately nicknamed “I Dig It.” (The moniker was a play on the name of the type of financial vehicle involved: an intentionally defective grantor trust.) One of the beauties of I Dig It was that it had the potential to largely circumvent not only the estate tax but also the federal gift tax. That tax applies to assets that multimillionaires give to their heirs while they’re alive and essentially serves as a backstop to the estate tax; otherwise, rich people could give away all their money before they die in order to avoid the estate tax. In Huang’s case, the details in securities filings are limited. But multiple experts, said it was almost certainly a classic I Dig It gift, loan and sale transaction. The $US7 million of shares Huang moved into his trust in 2012 are today worth more than $US3 billion ($4.7 billion). If those shares were directly passed on to Huang’s heirs, they would be taxed at 40 per cent – or well over $US1 billion. Instead, the tax bill will probably be no more than a few hundred thousand dollars. The Huangs soon took another big step toward reducing their estate tax bill. In 2016, they set up several vehicles known as “grantor-retained annuity trusts” or GRATs, securities filings show. They put just over 3 million Nvidia shares into their four new GRATs. The shares were worth about $US100 million ($156 million). If their value rose, the increase would be a tax-free windfall for their two adult children, who both work at Nvidia. That is precisely what happened. The shares are now worth more than $US15 billion ($23.4 billion), according to data from securities filings compiled by Equilar, a data firm. That means the Huang family is poised to avoid roughly $US6 billion ($9.4 billion) in estate taxes. If the Huangs’ trusts sell their shares, that will generate a hefty capital gains tax bill – more than $US4 billion ($6.2 billion), based on Nvidia’s current stock price. The Huangs can pay that bill on behalf of the trusts without it counting as a taxable gift to their heirs. Tax strategy Starting in 2007, Huang deployed another technique that would further reduce his family’s estate taxes. This strategy involved taking advantage of his and his wife’s charitable foundation. Huang has given the Jen Hsun & Lori Huang Foundation shares of Nvidia worth about $US330 million ($516 million) at the time of the donations. Such donations are tax-deductible, meaning they reduced the Huangs’ income tax bills in the years that the gifts took place. Foundations are required to make annual donations to charities equal to at least 5 per cent of their total assets. But the Huangs’ foundation is satisfying that requirement by giving heavily to what is known as a donor-advised fund. Such funds are pools of money that the donor controls. There are limitations on how the money can be spent. Buying cars or vacation homes or the like is off-limits. But a fund could, say, invest money in a business run by the donor’s friend or donate enough money to name a building at a university that the donor’s children hope to attend. There is a gaping loophole in the tax laws: Donor-advised funds are not required to actually give any money to charitable organisations. When the donor dies, control of the fund can pass to his heirs – without incurring any estate taxes. In recent years, 84 per cent of the Huang Foundation’s donations have gone to its donor-advised fund, named GeForce, an apparent nod to the name of an Nvidia video game chip. The Nvidia shares the Huangs have donated are today worth about $US2 billion ($3.1 billion). The fund is not required to disclose how its money is spent, though the foundation has said the assets will be used for charitable purposes. Matthew said those causes included higher education and public health. But there is another benefit. Based on Nvidia’s current stock price, the donations to the fund have reduced Huang’s eventual estate tax bill by about $US800 million ($1.2 billion). The killing of UnitedHealthcare CEO Brian Thompson appears to have added fresh fuel to already tense discourse online about wealth, the role of corporations in American health care and power in society. Thompson , 50, was in New York City for an investor conference, where he was shot dead by a masked assailant. Days later, the gunman’s whereabouts and identity remained unknown as did the reason for the killing. New York City police say evidence firmly points to it being a targeted attack. Steven Downing, associate professor of criminology and media at Ontario Tech University, said some posts were celebratory in nature and that reactions may reflect people’s frustration with the health insurance industry in the United States. A thread on a Reddit community, inviting people to share their worst experiences with UnitedHealthcare, drew hundreds of comments, mostly negative, and over a thousand upvotes. “There seems to be some effect here where people are sharing their own narratives,” Downing said. “People are strangely bonding over this.” Social media users reacted to the killing, with the term ‘CEOs’ trending on the social media website X. “I’ve seen very little sort of post being sympathetic to the victim,” Downing said. “Certainly, there is an anti-elitist sentiment that we’re seeing here.” Downing said that while this is a tragedy for those who knew Thompson, the social media reaction indicates a broader anti-elite social sentiment. He said there are also posts “valourizing” the shooter. “I saw a tweet specifically mentioning Robin Hood. The parallels are not exact, but there is this class element embedded in that, like an us versus them,” he said. The shooting has shaken corporate America and the health insurance industry in particular, causing companies to reevaluate security plans and delete photos and biographies of executives from their websites, the Associated Press reported. A different Minnesota-based health care company said Friday it was temporarily closing its offices out of an abundance of caution, telling employees to work from home. UnitedHealthcare is a multinational health insurance and services company and is the largest insurer in the United States . In 2023, Thompson earned a total compensation of $10.2 million, according to a disclosure by UnitedHealth Group. It included his annual salary, bonus and stock option awards. UnitedHealthcare brought in $281 billion in revenue last year. The killing has come amid growing tensions and anger as income inequality remains a persistent challenge, and after the U.S. election saw conversations around health care and the further privatization of insurance and care access in the spotlight. Caitlin Slavens, an Alberta-based psychologist, said posts valourizing a killer may not be a genuine endorsement of violence, but may reflect misplaced anger or desperation. “In this case, the shooter may symbolize rebellion against a system people feel has failed them — like health care or insurance industries. For some, it’s easier to justify or glorify such actions than to sit with the helplessness or rage they feel toward those larger systems,” she said. Amie Grant, a therapist based in Cleveland, Ohio, said prolonged exposure to an oppressive system or situation – like being denied life-saving care – can lead to people’s collective frustrations boiling over into extreme narratives. Social media offers an easy space for people to vent. “Social media amplifies these feelings by creating echo chambers where resentment can turn into dark humor or misplaced validation,” she said. Grant said growing income-inequality, stagnant wages and rising prices have led to a growing collective anger. “Online spaces provide a fertile ground for these feelings to take root, often through humor, memes, and dark satire that make complex issues more accessible. Social media acts as a pressure valve, allowing people to articulate their frustrations in ways that feel both rebellious and communal,” she said. Feeling powerless in the face of large corporations can feel dehumanizing, Slavens said. Sharing those experiences online can be cathartic for some. “Sharing personal stories, especially about struggles with insurance companies, can be incredibly validating. It allows people to feel seen and heard while connecting with others who have faced similar experiences,” Slavens said. “For some, it’s a way to reclaim power over a situation that feels dehumanizing, turning their pain into a call for systemic change.” Matthew Polacko, a postdoctoral research fellow at the University of Toronto whose work focuses on the effects of income inequality on political behaviour, said anti-elite sentiments are not limited to the United States. Canada, too, has seen simmering anger since the pandemic. “It’s definitely on the rise, this dissatisfaction with billionaires, in Canada with grocery stores and the rising prices. There is this perception of collusion on their part,” he said. Where that anger goes next remains unclear. Downing said these sentiments could well snowball into populist political movements in the future. “There’s a movement towards populist sentiments,” he said. “If you look at Occupy Wall Street, there were analogous or simultaneous movements in Canada.
